Chatqus
terms and conditions.
1. About these terms
These Terms and Conditions govern access to and use of Chatqus, including the shared inbox, conversation management, team assignment, and other supporting features we provide from time to time. Chatqus is operated by PT. Megadata Inovasi Solusindo ("Chatqus", "we", or "us").
By creating an account, accepting an offer, or using the service, you confirm that you have read and accepted these terms. If you use Chatqus on behalf of a company, you confirm that you have authority to bind that company.
2. Key terms
- Account means the credentials and configuration used to access a Chatqus workspace.
- Workspace means a customer's working environment containing users, channels, conversations, and service settings.
- Channel means a supported communication integration: WhatsApp, Instagram, or Messenger.
- Customer Data means data, messages, contacts, media, and other materials you enter into or transmit through the service.
- User means a person authorized by the customer to access a workspace.
3. Accounts and access
- Registration information must be accurate, complete, and kept up to date.
- You are responsible for keeping passwords, tokens, and administrator access confidential. Activity through your account is treated as authorized until you report unauthorized access to us.
- Access must only be granted to team members who need it for legitimate work.
- We may request additional verification or restrict access where there is a security risk, invalid information, or a breach of these terms.
4. Scope of service
Chatqus provides a workspace to help teams receive, read, assign, and follow up on conversations from WhatsApp, Instagram, and Messenger. Features, quotas, and usage limits follow the applicable plan or service agreement.
Third-party channel availability and behavior also depend on policies, APIs, approvals, and technical changes made by Meta or the relevant provider. We do not guarantee that third-party channels will always be available or remain unchanged.
5. Customer responsibilities
- Ensure that you have the legal basis, permission, or consent required to contact your customers and process their data.
- Use channels in accordance with Meta policies, applicable law, and reasonable communication standards. Do not send spam, fraud, malware, or content that infringes third-party rights.
- Ensure that your team reviews messages, templates, promotions, and decisions sent through Chatqus.
- Provide the information and access required for onboarding, verification, and troubleshooting without sharing unnecessary credentials.
6. Subscriptions, fees, and payments
- Prices, quotas, subscription periods, and features follow the offer, pricing page, invoice, or written agreement you receive.
- Fees must be paid by the invoice due date. Applicable taxes and third-party fees may be added in accordance with law or the relevant channel's fee structure.
- Plan changes or add-ons take effect as confirmed and may change fees for the current or following period.
- Cancellation takes effect at the end of the paid period unless otherwise agreed in writing. Setup fees, custom work, and services already used are not automatically refundable.
7. Onboarding and support
After an order or activation is confirmed, we may assist with initial workspace setup, channel connections, and basic usage according to your plan. Custom integrations, migration, automation, or additional training may incur separately agreed fees.
Our support focuses on the Chatqus platform. For issues originating from WhatsApp, Instagram, Messenger, Meta, networks, or third-party services, we assist within our capabilities, while resolution depends on the relevant provider.
8. Data and privacy
When processing contact data and conversation content entered into a workspace, Chatqus generally acts as a processor following the customer's instructions. The customer remains responsible for the purposes, legal basis, notices, and consent relating to the processing of end-customer data.
Our data processing practices are further described in the Chatqus Privacy Policy, which forms part of the service terms.
9. Prohibited use
- Disrupting, overloading, scanning, or attempting unauthorized access to the service, accounts, networks, or other users' data.
- Reverse engineering, copying, reselling, or creating derivative works from the service except as permitted in writing or by law.
- Using Chatqus for illegal activity, fraud, hate speech, exploitation, privacy violations, or intellectual property infringement.
- Sending content that breaches third-party channel policies or bypassing channel limits, verification, or security measures.
10. Intellectual property
Rights to Chatqus names, trademarks, code, designs, documentation, and components remain with us or our licensors. We grant a limited, non-exclusive, non-transferable right to use the service while your subscription is active and subject to these terms.
You retain ownership or control of Customer Data. You grant us limited permission to store, process, display, and transmit Customer Data to the extent necessary to provide the service.
11. Suspension and termination
We may suspend or restrict access for a breach of these terms, overdue payment, security risks, an authorized order, or use that may harm the service or others. Where possible, we will provide notice and an opportunity to remedy the breach.
Access may end when the service terminates. Certain data may be retained for a limited period for recovery, audit, security, or legal obligations in accordance with the Privacy Policy.
12. Limitation of liability
Chatqus supports team operations and does not guarantee particular business results, lead volumes, or customer decisions. You remain responsible for reviewing conversations and decisions based on information within the workspace.
We work to keep the service secure and available but are not responsible for disruption beyond our reasonable control, including third-party channel failures, networks, customer devices, force majeure, or user actions.
To the extent permitted by law, our liability for direct losses proven to result from our fault is limited to the service fees paid by the customer for the period in which the event occurred. This limit does not exclude liability that cannot legally be limited.
13. Changes and governing law
We may update these terms to reflect changes in the service, business, security, or regulations. Material changes will be communicated through reasonable channels. Continued use after the effective date means acceptance of the latest version.
These terms are governed by the laws of the Republic of Indonesia. Disputes will first be addressed through discussion; if unresolved, the parties may use a competent dispute resolution forum in Indonesia.
